2) Collection and storage of personal data and the nature and purpose of their use

a) When visiting the website

When you access our website, the browser used on your terminal device automatically sends information to the server of our website. This information is temporarily stored in a so-called log file. The following information is collected without your intervention and stored until automatic deletion:

b) When using our contact form

For questions of any kind, we offer you the possibility to contact us via a form provided on the website. In doing so, it is necessary to provide your name, a valid e-mail address and the specific request so that we know from whom the request originates and in order to be able to answer it. Further information can be provided voluntarily.

The personal data collected by us for the use of the contact form will be deleted after completion of your request, unless another legitimation basis (e.g. a specific order) justifies further processing.

Data processing for the purpose of contacting us is carried out in accordance with Art.6 Para.1 lit.b DSGVO on the basis of your specific enquiry.

In order for you to send us an enquiry via the contact form, we require your consent to use reCAPTCHA. This is a function of Google Ireland Limited, Gordon House, 4 Barrow St, Dublin, D04 E5W5, Ireland (“Google”). The main purpose of this function is to distinguish whether an entry is made by a natural person or improperly by machine and automated processing. The service includes the sending of the IP address, referrer URL (the address of the page from which the visitor comes), information about the operating system, cookies mouse movements and keystrokes, dwell time, user device settings (eg language settings, location, browser, etc.) and possibly other data required by Google for the service reCAPTCHA to Google.

The use of Google reCAPTCHA may also result in the transmission of personal data to the servers of Google LLC. in the USA. There is no general adequacy decision of the European Commission for the USA, which certifies an adequate level of data protection in the USA. By transferring your personal data, there is a risk that US authorities will access them and process them for their own purposes.

The legal basis for this processing and the transfer of your personal data to the USA is your consent in accordance with and Art. 49 (1) p. 1 lit. a) DS-GVO. c) When using our newsletter

On our website there is the possibility to subscribe to a free e-mail newsletter. When registering for the newsletter, the data from the input mask is transmitted to us.

  • Name
  • First name
  • Salutation
  • E-mail address

In addition, the following data is collected during registration:

  • IP address of the calling computer
  • Date and time of registration

For the processing of data, your consent is obtained during the registration process and reference is made to this privacy policy.

If you commission us with the provision of services and provide us with your e-mail address, this may subsequently be used by us for the dispatch of a newsletter. In such a case, only direct advertising for our own similar products or services will be sent via the newsletter.

No data is passed on to third parties in connection with the processing of data for the dispatch of newsletters, with the exception of our dispatch service provider. The data is used exclusively for sending the newsletter.

The collection of the user’s e-mail address serves to deliver the e-mail newsletter. The collection of other personal data during the registration process serves to prevent misuse of the services or the e-mail address used.

The data is deleted as soon as it is no longer required to achieve the purpose for which it was collected. The e-mail address of the user is therefore stored as long as the subscription to the newsletter is active.

The other personal data collected during the registration process is usually deleted after a period of seven days.

The subscription to the newsletter can be cancelled by the user concerned at any time. For this purpose, a corresponding link can be found in each newsletter. This also enables the revocation of consent to the storage of personal data collected during the registration process.

The legal basis for the processing of data after registration for the newsletter by the user is the existence of a consent of the user (Art.6 Abs.1 lit.a DSGVO). The legal basis for sending the newsletter as a result of the sale of goods or services is Art. 6 para. 1 lit. f in conjunction with § 7 para.3 UWG.

Use of the dispatch service provider “MailChimp”

The newsletter is sent using “MailChimp”, a newsletter sending platform of the US provider Rocket Science Group, LLC, 675 Ponce De Leon Ave NE #5000, Atlanta, GA 30308, USA.

The email addresses of our newsletter recipients, as well as their other data described in these notes, are stored on the servers of MailChimp in the USA. MailChimp uses this information to send and evaluate the newsletter on our behalf. Furthermore, according to its own information, MailChimp may use this data to optimise or improve its own services, e.g. for the technical optimisation of the dispatch and the presentation of the newsletters or for economic purposes in order to determine from which countries the recipients come. However, MailChimp does not use the data of our newsletter recipients to address them itself or to pass them on to third parties. For the USA, there is no general adequacy decision of the European Commission that certifies an adequate level of data protection for the USA. By transmitting your personal data, there is a risk that US authorities will access them and process them for their own purposes.
We have concluded a “Data Processing Agreement” with MailChimp. This is a contract in which MailChimp undertakes to protect the data of our users, to process it on our behalf in accordance with its data protection provisions and, in particular, not to pass it on to third parties. Login data

To subscribe to the newsletter, it is sufficient to enter your e-mail address.

Optionally, we ask you to enter your first and last name. This information is only used to personalize the newsletter. Furthermore, we also ask you to optionally enter your date of birth, gender and industry. We only use this information to adapt the contents of the newsletter to the interests of our readers.

Statistical survey and analyses

The newsletters contain a so-called “web beacon”, i.e. a pixel-sized file that is retrieved from the MailChimp server when the newsletter is opened. Within the scope of this retrieval, technical information, such as information about the browser and your system, as well as your IP address and the time of the retrieval are initially collected. This information is used for the technical improvement of the services based on the technical data or the target groups and their reading behavior based on their retrieval locations (which can be determined with the help of the IP address) or the access times.

The statistical surveys also include determining whether the newsletters are opened, when they are opened and which links are clicked. For technical reasons, this information can be assigned to individual newsletter recipients. However, it is neither our intention nor that of MailChimp to observe individual users. The evaluations serve us much more to recognize the reading habits of our users and to adapt our content to them or to send different content according to the interests of our users.

Online call and data management

There are cases in which we direct newsletter recipients to MailChimp’s websites. For example, our newsletters contain a link with which the newsletter recipients can call up the newsletter online (e.g. in the event of display problems in the email program). Furthermore, newsletter recipients can subsequently correct their data, such as the email address. Likewise, the privacy policy of MailChimp is only available on their site.

In this context, we pointed out that cookies are used on the websites of MailChimp and thus personal data is processed by MailChimp, its partners and service providers used (e.g. Google Analytics). We have no influence on this data collection. For more information, please refer to the privacy policy of MailChimp. Cancellation/revocation

You can cancel the receipt of our newsletter at any time, i.e. revoke your consent. With this, your consents to its dispatch via MailChimp and the statistical analyses expire at the same time. A separate revocation of the dispatch via MailChimp or the statistical analysis is unfortunately not possible.

Your personal data will not be transferred to third parties for purposes other than those listed below.
We will only share your personal information with third parties if:

  • you have given your express consent in accordance with Art.6 Para.1 lit.a DSGVO,
  • the disclosure is necessary in accordance with Art.6 Para.1 lit.f DSGVO and there is no reason to assume that you have an overriding interest worthy of protection in the non-disclosure of your data,
  • in the event that there is a legal obligation for the disclosure pursuant to Art. 6 Para. 1 lit. c DSGVO, as well as
  • this is legally permissible and required according to Art. 6 Para. 1 lit. b DSGVO for the processing of contractual relationships with you.

This is a tag management system for managing JavaScript and HTML code snippets with which tracking, analysis, personalization and marketing performance tags and tools can be implemented. Google Tag Manager

For our website we use the Google Tag Manager of the company Google LLC. For the European area the company Google Ireland Limited (Gordon House, Barrow Street Dublin 4, Ireland) is responsible for the Google Tag Manager.

Bertsch Innovation GmbH uses Facebook to provide information about the company and to communicate via the network with the users active there. Furthermore, data may be processed through the use of Facebook for market research and advertising purposes. This is carried out, for example, on the basis of tracking, whereby, among other things, interest- or behaviour-related profiling or cookies may be used. However, remarketing and reach measurement are also used, for which purpose, for example, access statistics – which recognize returning visitors – are created.

In connection with the use of our online presence on Facebook and your use of Facebook, the following types of data may be processed: Inventory data and contact data (e.g. name, address, email, telephone number), content data (e.g. entries in online forms, use of the message function), usage data (e.g. access to web pages, clicks, access times), metadata and communication data (e.g. device information, IP addresses).

With regard to the data processing on our Facebook fanpage and through the Facebook plugin, Bertsch Innovation GmbH and Facebook Ireland are joint controllers according to Art. 26 DS-GVO. The legal basis for the processing of personal data is Art. 6 (1) or lit. f) DS-GVO. You can assert your data subject rights with Facebook directly as well as with us. The primary responsibility under the GDPR for the processing of Insights Data lies with Facebook and Facebook complies with all obligations under the GDPR with regard to the processing of Insights Data. We, as the operator, do not make any decisions regarding the processing of Insights data and all other information resulting from Art. 13 DS-GVO, including legal basis, identity of the controller and storage period of cookies on user terminals.

Bertsch Innovation GmbH maintains an online presence in the social network “LinkedIn” and uses other tools of the company (LinkedIn-Inside Tags, -Analytics and –Ads). User data is processed in this context.

6.4.1 Online presence

Bertsch Innovation GmbH uses the online presence of LinkedIn to provide information about the company and to communicate via the network with the users active there. The service provider is LinkedIn Ireland Unlimited Company, Wilton Place, Dublin 2, Ireland, website: https://www.linkedin.com. Furthermore, data may be processed through the use of LinkedIn for market research and advertising purposes. This is carried out, for example, on the basis of tracking, whereby, among other things, interest or behaviour-related profiling or cookies may be used. However, remarketing and reach measurement are also used, for which purpose, for example, access statistics – which recognize returning visitors – are created.

The legal basis for the data processing is Art. 6 para. 1 p. 1 lit. f) DS-GVO.

6.4.2 LinkedIn Inside Tags

Bertsch Innovation GmbH uses LinkedIn Inside Tags, LinkedIn Analytics and LinkedIn Ads (together “LinkedIn Tools”) for the purpose of online marketing, including in particular the marketing of advertising space or the display of advertising and other content. The service provider is LinkedIn Ireland Unlimited Company, Wilton Place, Dublin 2, Ireland and LinkedIn Corporation, 2029 Stierlin Court, Mountain View, CA 94043, USA, website: www.linkedin.com.
LinkedIn tools are used on the one hand to improve the quality of our website and its content. In this way, we learn how the website is used and can thus constantly optimize our offer. On the other hand, these tools can be used to display personalised advertisements on LinkedIn to visitors to this website.

For this purpose, we create user profiles that are stored by means of a file (so-called “cookie”). For this purpose, data is processed such as content accessed, websites visited (e.g. advertising identifiers, articles or videos viewed but also search terms), online networks used and likes or communication partners and technical details such as browser, computer system and details of usage times. If you have consented to the collection of your location data, this may also be processed.

The IP address of the user is stored in a shortened form using the available IP masking procedure (i.e. pseudonymisation by shortening the IP address) to protect the user. In general, no clear data of the users (such as e-mail addresses or names) are stored within the scope of the online marketing procedure, but pseudonyms. However, clear data can be assigned to the profiles, especially if the users are members of LinkedIn.
In principle, we only receive access to summarised information about the success of our advertisements. By means of conversion measurements, however, we can check which of our online marketing processes has led to a contract being concluded with us.

Although, according to LinkedIn, LinkedIn Ireland is the responsible party, we would like to point out that it cannot be ruled out that the information collected by the cookies will be sent to a LinkedIn server in the United States of America (USA) and stored there. There is no general adequacy decision of the European Commission for the USA, which certifies an adequate level of data protection for the USA. By transmitting your personal data, there is a risk that US authorities will access them and process them for their own purposes.

The legal basis for this processing and the transfer of your personal data to LinkedIn in the USA is your consent in accordance with Article 6 (1) sentence 1 a) and Article 49 (1) sentence 1 a) DS-GVO. You have the option to revoke your consent at any time. You can adjust your privacy settings for our website by clicking the link “privacy settings” in the footer of our website at the bottom right.

6.4.3 Basic information

7) Deletion of data

The data stored by us will be deleted as soon as they are no longer required for their intended purpose or you revoke your consent and the deletion does not conflict with any statutory retention obligations. If the user data is not deleted because it is required for other and legally permissible purposes, its processing will be restricted. I.e. the data is blocked and not processed for other purposes. This applies, for example, to user data that must be retained for reasons of commercial or tax law.

According to legal requirements the storage is carried out for 6 years according to § 257 Abs. 1 HGB (commercial books, commercial letters, etc.) as well as for 10 years according to § 147 Abs. 1 AO (commercial and business letters, documents relevant for taxation, etc.).

8) Data subject rights

You are entitled to the following data subject rights:

a) Right to information

You have the right to request confirmation from us as to whether personal data relating to you is being processed.

(b) rectification/deletion/restriction of processing

Furthermore, you have the right to demand from us that
• inaccurate personal data concerning you be corrected without delay (right to rectification);
• personal data concerning you are deleted without delay (right to erasure), and
• the processing is restricted (right to restrict processing).

(c) the right to data portability

You have the right to obtain personal data concerning you that you have provided to us in a structured, commonly used and machine-readable format and to transfer this data to another controller.

d) Right of withdrawal

You have the right to revoke your consent at any time. The revocation of consent does not affect the lawfulness of the processing carried out on the basis of the consent until the revocation.

(e) Right of objection

If the processing of personal data concerning you is necessary for the performance of a task carried out in the public interest (Article 6(1)(e) DSGVO) or for the protection of our legitimate interests (Article 6(1)(f) DSGVO), you have the right to object.
